(CS) An oversight in the 2011 child protection laws will be corrected and the revised laws are set to come into action on February 15.
The July 2011 revision had left out an age specific clause to the so-called “attentat à la pudeur.” Previously, in case of sexual offences without threat or physical violence, offenders were charged with between five to ten years of prison when the child was under 11, and one to five years in prison when the child was under 16.
This clause was accidentally omitted in 2011 and will now be re-introduced, coming into action in February.
Until then, the 2011 text will be valid, affecting four cases, as general state attorney Robert Biever said at a meeting of the justice commission on Wednesday.
In two cases investigations have just been completed, but neither has moved to court so far. Another case is currently on trial. The fourth case, which has already been tried, led to the discovery of the oversight in the 2011 laws.
The commission is currently debating what measures can be taken in the affected cases.
